ANC 5A Medical Cannabis Shop Protest Second Motion for Reconsideration Denied

Clinical Health & Wellness is seeking to open a cannabis shop at 4942 South Dakota Avenue NE in ANC 5A08 in North Michigan Park. Elaine Alston is the ANC commissioner for the area.

ANC 5A sought to protest the license application. The ABCA Board dismissed the ANC’s protest for lack of statutory grounds. ANC 5A sought reconsideration of the Board’s dismissal. The Board denied reconsideration.

Apparently, the ANC filed a second motion for reconsideration. On September 10, 2025, the Board denied the ANC’s second motion for reconsideration.

  1. Do we have any other legal recourse? Have any other ANCs been successful in getting their motions adopted? If so, did we use them as guidelines? What is the next legal step we can take?   2. I am no lawyer, but if ANC5A goes to the DC Court of Appeals the following will most likely happen. The Appeals Court “..typically focuses on whether the agency correctly applied the law and reviews only the evidence that was part of the original record.” Therefore, new information will not be considered unless the Alcoholic Beverage and Cannabis Administration (ABCA) made a mistake in applying the law. The problem is that ANC5A’s initial protest submission did not provide sufficient evidence.
